
In case you haven’t heard yet, a draft law on motor insurance has just been approved, transposing Directive 2021/2118.
This new draft law aims to protect the victims of the vehicles being regulated, speeding up the payment of compensation and, at least in theory, increasing the amount of compensation. In addition, the Insurance Compensation Consortium will guarantee the payment of compensation in the event of insolvency of the insurer. (If you do not know what it is, click here).
Until now, these were vehicles that were not obliged to have liability insurance (liability insurance, in this case, covers you against damage that you may cause to third parties, persons or things, using the insured vehicle).
This law is a national law and therefore also applies in Mallorca.
When does the Motor Insurance Act start to apply?
Expected in 2026.
Who is affected by this law?
Agricultural and industrial vehicles, as well as personal mobility vehicles,scooters.(see the image)
What changes with this “scooter” law?
On the one hand, agricultural or industrial vehicles are obliged to take out civil liability insurance, for which they will have a period of 6 months from the publication of the Law to do so.
On the other hand, as far as scooters are concerned, there are two changes:
- Owners must have compulsory civil liability insurance.
2.They must be registered in a public register of light personal vehicles (to be established by 2 January 2026).
In summary, this is the information we have as of today, however, there is still a long way to go before this is implemented so there may be modifications.
